The Chief Judge of Katsina State, Justice Musa Danladi Abubakar, has issued a stern warning to magistrates and sharia court judges against interfering with police investigations. In a speech delivered at the swearing-in ceremony of newly appointed magistrates and sharia court judges, Justice Abubakar stated that any judge who grants an order stopping a police investigation will be removed from their position.
The Chief Judge emphasized that magistrates and sharia courts lack the jurisdiction to halt police investigations.
He described this practice as a dangerous trend in the administration of justice that is unacceptable. Justice Abubakar highlighted that the police are established by law and are guided by the Police Act and the Administration of Criminal Justice Act, which empowers them to arrest, prosecute, and investigate any case brought to their attention.
He stressed the importance of collaboration between the courts and the police in ensuring fair and efficient justice delivery. Justice Abubakar explained that only the state High Court, the High Court of the Federal Capital Territory Abuja, and the Federal High Court have the authority to grant orders stopping police investigations.
The Chief Judge commended the Katsina State Police Command for raising concerns about the practice of magistrates and sharia judges issuing such orders.
He assured that both the judiciary and the police will continue to work together to ensure the swift and efficient dispensation of justice. LJustice Abubakar also used the occasion to warn judges in the state against absenteeism and delays in delivering judgments.
He emphasized that his administration would not tolerate such behaviour and would take disciplinary action against any judge found guilty of these offences.
He charged the newly appointed magistrates and sharia court judges to adhere to the code of conduct and to fear Allah in the discharge of their duties.
